Terms of Service

1. Acceptance of Terms

By accessing or using IsThisAI ("the Service"), available at isthisai.lol, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

IsThisAI is an online game where users attempt to distinguish between AI-generated images and real photographs. The Service includes:

  • Various game modes (Quick Play, Timed, Survival, Random)
  • User accounts and profiles
  • Leaderboards and score tracking
  • Community reporting features
  • User content uploads (subject to review)

3. User Accounts

3.1 Account Creation

You may use the Service as a guest or create an account. You can register using email/password or through social authentication (Google, Facebook, or X). When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password and social accounts
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Requirements

  • You must be at least 13 years old to create an account
  • One account per person is allowed
  • Accounts are non-transferable

3.3 Account Termination

You may delete your account at any time through the account settings. We reserve the right to suspend or terminate accounts that violate these Terms, including accounts that receive multiple copyright strikes.

4. Acceptable Use

When using the Service, you agree NOT to:

  • Attempt to manipulate scores, leaderboards, or game outcomes
  • Circumvent or disable any security features
  • Interfere with the proper functioning of the Service

  • Impersonate others or create fake accounts
  • Collect or harvest user data without authorization

5. User-Generated Content

5.1 Content Uploads

Registered users may upload images and videos to be considered for inclusion in the game. By uploading content, you represent and warrant that:

  • You are the creator of the content, OR
  • You have obtained all necessary rights, licenses, and permissions to upload and share the content
  • The content does not infringe on any third party's intellectual property rights, including copyrights, trademarks, or trade secrets
  • The content does not violate any applicable laws or regulations
  • The content is not defamatory, obscene, pornographic, or harmful

5.2 License Grant

By uploading content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your content in connection with operating and promoting the Service. This license continues even if you delete your account, for content that has already been incorporated into the game.

5.3 Content Review

All user-uploaded content is subject to review before being made available in the game. We reserve the right to reject, remove, or disable access to any content at our sole discretion, including but not limited to content that:

  • Violates these Terms
  • Infringes on intellectual property rights
  • Is inappropriate or offensive
  • Does not meet our quality standards

5.4 Indemnification for Uploaded Content

You agree to indemnify, defend, and hold harmless IsThisAI, its operators, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to content you upload, including any claims of copyright or intellectual property infringement.

6. Copyright and DMCA Policy

6.1 Respect for Copyright

We respect the intellectual property rights of others and expect our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and applicable laws.

6.2 DMCA Takedown Procedure

If you believe that content on our Service infringes your copyright, please submit a DMCA takedown notice to our designated agent. Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on our Service
  • Your contact information (address, phone number, email)
  • A statement of good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

6.3 Repeat Infringer Policy

We maintain a strict repeat infringer policy. Users who repeatedly upload content that infringes on others' copyrights will have their upload privileges revoked and may have their accounts terminated:

  • First Strike: Warning and content removal
  • Second Strike: Final warning and content removal
  • Third Strike: Permanent ban from uploading content

We track copyright strikes indefinitely. Strikes cannot be appealed except through a valid DMCA counter-notification process.

7. Game Content

7.1 Curated Content

The images displayed in the game are curated by us or submitted by users. We make reasonable efforts to ensure content is appropriate, but we do not guarantee the accuracy of image labels or the appropriateness of all content.

7.2 Reporting Issues

If you encounter problematic content, please use our Report page to notify us. You can report:

  • Broken or missing images
  • Incorrectly labeled content (AI marked as real, or vice versa)
  • Inappropriate or offensive content
  • Potential copyright infringement
  • Other issues affecting your experience

We review all reports and take appropriate action at our discretion.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the Service
  • Reverse engineer or attempt to extract source code
  • Use our trademarks without permission
  • Create derivative works based on the Service

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages exceeding the amount you paid us (if any)
  • Claims arising from user-uploaded content

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload to the Service
  • Any copyright or intellectual property claims related to your uploads

12. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features, functionality, or content
  • Impose limits on certain features or access
  • Remove user-uploaded content at any time

We will make reasonable efforts to notify users of significant changes.

13. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting. Your continued use of the Service after changes constitutes acceptance of the new Terms.
