DMCA Policy

1. Introduction

IsThisAI ("we," "us," or "our") respects the intellectual property rights of others and expects users of our Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

3. Filing a DMCA Takedown Notice

If you believe that content on our Service infringes your copyright, please submit a written notification containing the following information:

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL where the content appears)
  4. Your contact information, including your name, address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. How We Process Takedown Requests

Upon receiving a valid DMCA takedown notice, we will:

  1. Review the notice for completeness and validity
  2. Remove or disable access to the allegedly infringing content
  3. Notify the user who uploaded the content (if identifiable)
  4. Record the content hash to prevent re-upload
  5. Issue a copyright strike to the uploader's account

We aim to process valid takedown requests within 24-48 hours of receipt.

5. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

What Happens After a Counter-Notification

Upon receiving a valid counter-notification:

  • We will forward a copy to the original complainant
  • We will inform them that we may restore the content in 10-14 business days
  • If the complainant does not file a court action seeking a restraining order within that time, we may restore the content
  • If the counter-notification is successful, the associated copyright strike will be removed from your account

6. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, users who are repeat infringers.

Strike System

  • First Strike: Warning notification and content removal
  • Second Strike: Final warning and content removal
  • Third Strike: Permanent revocation of upload privileges

Important Notes

  • Strikes are tracked indefinitely and do not expire
  • Strikes apply to uploads that are subject to valid DMCA takedown notices
  • Strikes may be removed if a successful counter-notification is filed
  • We reserve the right to terminate accounts with egregious or repeated violations
